Swimming Pool Regulations in Florida

Florida residents are fond of their swimming pools. Swimming pools provide a welcome respite from the sun and heat and are also a wonderful source of entertainment for families. Unfortunately, swimming pools are also inherently dangerous.

The legislature of the state took note of the fact that drowning in a pool was the leading cause of death for young children in Florida and that drowning was also a major cause of death among the medically frail elderly population in the state. Because of the significant hazards associated with pools, Florida codified safety rules for pools in its Residential Swimming Pool Safety Act. The law provides that pools built after October 1, 2000 must adhere to at least one of the following requirements to pass final inspection and receive a certificate of completion:

  • The pool must be isolated from access to a home by a barrier that is at least 4 feet high.
  • The pool must have an approved safety pool cover.
  • The doors and windows that lead to the pool must have an alarm.
  • The doors leading to the pool must have a self-closing, self-latching device situated no lower than 54 inches above the floor.

If you or a loved one suffered injury or if a loved one was killed in a swimming pool accident, you have the right to seek fair compensation for your loss by filing a personal injury or wrongful death lawsuit.  Reach out to an Fazio, Disalvo & Abers in Fort Lauderdale to learn more about your options.
