Sexual Harassment

Sexual harassment may take many forms. Unwanted physical contact, unwelcome advances or remarks or other actions may create a hostile working environment. Examples of sexual harassment can include, among other things:

Unwelcome comments or remarks about your body or clothes

Where an employee suffers an adverse employment action for failing to give in to unwelcome advances, or the employer knew or should have known about the harassment but failed to take action, the employer may be held liable for the harassment and required to compensate the employee for the damages suffered. Many sexual harassment victims allow the abuse to continue because they are afraid to lose their job or sometimes blame themselves for what has happened. Nonetheless, in many instances, the law requires that the employer be given notice of the harassment before the employer can be held liable.

The laws prohibiting sexual harassment in the workplace can be fairly complex, with strict applications and deadlines, which demand specialized knowledge, experience and skill. We have extensive experience in prosecuting and defending sexual harassment claims, from the administrative level through trial and appeal, in state and federal courts.
