  • The defendant now has 30 days in which to file a response to these papers. This response sometimes includes countercharges leveled back at the plaintiff.
  • The next step involves interrogatories. These are sets of written questions exchanged within 60 days of the lawsuit being filed, and typically must be answered within 35 days of being mailed. Your medical records will likely be subpoenaed, especially if you are pursuing a medical malpractice lawsuit, and the defense may ask you to be examined by another doctor of its choosing.   • Oral depositions follow, usually within six months of the lawsuit being filed. This is not as formal as a trial, but involves sitting before a lawyer with a court reporter, and answering questions posed by the other personal injury litigation lawyer.

Approaching a conclusion

  • At some point in the process, settlement discussions begin, and the court will usually ask for mediation. During mediation, a neutral third party works with the two parties and the injury litigation lawyers to reach an amicable resolution.
  • If mediation fails, the case proceeds to trial, which can take days or weeks to complete, based on the complexity of the matter.
  • If mediation succeeds, however, all parties sign a documented agreement, and funds are generally made available to the injured victim within thirty days.
